AMENDMENT TO HARMONISED CIVIL AVIATION SAFETY AND SECURITY REGULATIONS

 

Starting from November 2006, the East African Community issued Model harmonized Civil Aviation Regulations in various areas of the sub-sector covering international safety and security standards as developed by the International Civil Aviation Organisation (ICAO) and issued in the Annexes to the Chicago Convention.

The Partner States – Kenya, Tanzania and Uganda – promulgated the harmonized Regulations in their respective States. These Regulations are being implemented in regulating the aviation activities in their respective countries. The Republics of Burundi and Rwanda after joining the Community are also harmonizing their regulations in line with the EAC Harmonized Regulations and expect that at the end of this review exercise their Regulations will be in line with the Model harmonised EAC Regulations.

The five partner States at different times have undergone ICAO audits under the Universal Safety Oversight audit programme (USOAP) and Universal Security Audit Programme (USAP).

The Agency (CASSOA), a specialised institution of the EAC responsible for civil aviation safety and security oversight, is mandated to ensure that the region aviation sub-sector operates under harmonised regulations which meet the international standards under the Chicago Convention.

The Agency is currently in the process of amending the harmonised Civil Aviation Regulations which is necessitated by three main reasons:

  1. As a process to implement corrective action plans developed from the outcome of the various audits under the ICAO USOAP and USAP to the Partner States;

  1. As a process to address the amendments to the various Annexes to the Chicago Convention which were issued after the development and promulgation of the harmonised Regulations; and

  1. To address genuine concerns raised by stakeholders and experience gained in the implementation of the harmonised Regulations.

Each set of Regulations considered for amendments from reasons specified above, was done by the specific technical Working Groups (WG) and subsequently the legal WG. The Regulations amendments for each set of Regulations are indicated in a table, tabulating all the proposed amendments. The complete set of Regulations is also included with the proposed amendments, which are colour highlighted. In making reference to the current Regulations, in addition to the number of regulation please also make reference to the title of the particular provisions – the numbering may be different from those promulgated by States.

Take note that the Civil Aviation (Aircraft Accident and Incident Investigation) Regulations is a new draft as it was not previously harmonised and issued. The amendment indicated is an amendments done after States’ consultation on the draft considered previously by the joint technical experts and Legal WG.

These proposed amendments were considered and approved by the Agency Board during its 12th Meeting in Entebbe from 29th to 30th July 2010. The Board as empowered by the Protocol establishing CASSOA directed that the amended regulations be forwarded to states for domestication and promulagtion.
